Terms of Service

These Terms of Service govern your use of Earmarkr, a service operated by BP Technology Advisors LLC. By creating an account or using the service, you agree to these terms. Please read them carefully.
The service
Earmarkr is a hosted, subscription-based personal-finance and budgeting application operated by BP Technology Advisors LLC (“Earmarkr”, “we”, “us”). We provide the software, hosting, and bank-connection features; you provide accurate account information and use the service responsibly. Earmarkr is a budgeting tool, not a bank, lender, or financial, tax, or investment advisor.
Your account
- You must provide accurate information and keep it current.
- You are responsible for safeguarding your password and for all activity under your account.
- Two-factor authentication is required to help keep your account secure.
- You must be at least 18 years old (or the age of majority where you live) to use Earmarkr.
Subscriptions and billing
- Earmarkr is offered on a monthly ($5/month) or yearly ($50/year) subscription. Prices are in US dollars and may change with notice.
- As a launch offer, the first 100 subscriptions receive 50% off during the beta period. Introductory pricing applies as described at sign-up.
- Payments are processed by Paddle (paddle.com), which acts as the merchant of record for your purchase. Your purchase is also subject to Paddle’s buyer terms.
- Subscriptions renew automatically at the end of each billing period unless you cancel beforehand.
- You can request a refund within 14 days of any payment, as described in our Refund Policy. You can also cancel anytime; access continues through the end of the period you have already paid for.
Acceptable use
You agree not to:
- Use the service for any unlawful purpose or to violate anyone’s rights.
- Attempt to breach, probe, or disrupt the security or integrity of the service.
- Reverse engineer, resell, or misuse the service or its data beyond your own personal use.
- Upload malicious code or interfere with other users’ access.
Third-party connections
Earmarkr uses Plaid to connect to your financial institutions. Your use of those connections is also subject to Plaid’s and your bank’s own terms and privacy policies. We are not responsible for the accuracy or availability of data provided by third parties.
Your data
You retain ownership of the financial data you put into Earmarkr. You grant us the limited permission needed to store, process, and display it to provide the service. Our handling of your data is described in the Privacy Policy.
Disclaimers
Earmarkr is provided “as is” and “as available.” While we strive for accuracy — money is computed in exact integer units and core engines are tested against their invariants — we do not warrant that the service will be uninterrupted, error-free, or that imported bank data will always be complete or correct. You are responsible for your own financial decisions.
Limitation of liability
To the maximum extent permitted by law, Earmarkr and BP Technology Advisors LLC will not be liable for indirect, incidental, or consequential damages, or for any loss arising from your use of (or inability to use) the service. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.
Suspension and termination
You may stop using Earmarkr and close your account at any time. We may suspend or terminate access if you violate these terms or if necessary to protect the service or its users. On termination, your right to use the service ends, and we handle your data as described in the Privacy Policy.
Changes to these terms
We may update these terms as the product evolves. When we make material changes, we will update the effective date above and, where appropriate, notify you. Continuing to use Earmarkr after changes take effect means you accept the updated terms.
